AN Asaba Chief Magistrates Court has sentenced one Kelvin Egbuna to nine years imprisonment for breaking into a house and stealing a Redmi phone and a power bank.
He was tried on two-count charges and found guilty of the offences preferred against him.
The Count 1 read: “That you, Kelvin Egbuna, broke into the house of Mr Ekpereka Obi at about 1:00 a.m. while he was sleeping, committing the offence of stealing a Redmi phone, property of Mr Ekpereka Obi.” Count 2 stated: “That you, Kelvin Egbuna, in the Asaba magisterial district, did unlawfully enter the house of one Mr Ekpereka Obi to wit, stealing a Redmi phone and one power bank, punishable under Section 390(9) of the Criminal Code Law.” The defendant testified to the court that he broke into the house of Mr Ekpereka Obi at about 1:00 a.m. while he was asleep, stealing a Redmi phone and a power bank. The witness also testified that the defendant was caught and taken to the police station.
The defendant was found guilty on both counts and was convicted and sentenced to six years’ imprisonment with hard labour for breaking into an apartment at midnight. In addition, he was sentenced to three years’ imprisonment for stealing, without the option of a fine.
The court also ordered the convict to pay the sum of ₦500,000 to the nominal complainant.
