THE Delta State High Court sitting in Asaba and presided over by Justice M. Obi has adjourned proceedings in the case between Chief Agada and First Bank to allow the claimant to appear in court and explain the alleged failure to comply with an earlier court order.
During the hearing, counsel for the defendant urged the court to dismiss the suit, arguing that the claimant had continued to disobey the court’s orders throughout the proceeding.
“The claimant chooses to stubbornly not to obey the order of the court,” said the defence counsel.
The defence also told the court that instead of complying with the court’s directive, the claimant had chosen to file what it described as frivolous applications, which counsel argued were intended to delay the progress of the case.
Counsel further informed the court that the claimant was absent from the sitting and alleged that the action suggested an attempt to waste the court’s time. The defence also maintained that the claimant had failed to substantiate the claims brought before the court.
On that basis, the defence asked the court to dismiss the case, citing the claimant’s alleged disobedience of the court order and failure to provide explanations for such action.
Justice Obi, however, adjourned the matter to 15 April 2026 to enable the claimant to appear before the court and provide explanations before making decisions.
