Court Bars Police From Arresting Eight Ogwashi-Uku Residents

The Ogwashi-Uku High Court has temporarily restrained the Inspector-General of Police (IGP) and six others from arresting Mr Benson Okafor and seven co-applicants, pending the determination of a motion filed before the court.

The motion, filed ex parte by Barr Benjamin Okoh, seeks to protect the applicants from what they describe as harassment, intimidation, and unlawful arrest.

Justice Flora Azinge, presiding over the matter, noted, “For an interim injunction to be granted, the court must hear from the defendants.” However, she allowed the applicants to serve the IGP and the Assistant Inspector General of Police, Zone 5, through the Commissioner of Police, Delta State Command.

The applicants are invoking their fundamental human rights as guaranteed by the Nigerian Constitution, arguing that their rights are under threat.

Barr. Okoh, speaking after the hearing, said, “This motion is crucial to ensure that the rights of my clients are safeguarded. No citizen should face intimidation without due process.”

The court also ordered that the enrolled order and the motion on notice be formally served on the respondents before the next hearing. The case, filed as Suit No: 0/M/89/2025, has been adjourned to February 2, 2026, for further proceedings.
